Facing criminal charges or a lawsuit is a scary and stressful time and this is probably the most important work we do, because it deals with someone's freedom or financial future. Just look at the wrongful accusations against Richard Jewell in the Atlanta bombing, the government's failure to disclose interviews in the Oklahoma City Bombing, the police investigator ADMITTING he left exculpatory evidence out of his reports in the Scott Peterson trial, the indictment of a government agent in the Martha Stewart trial for perjury and ultimately the tragedy in Tulia, Texas, where numerous individuals went to prison on unreliable evidence, only to have the cases overturned once the truth was exposed about the government's main witness, a police undercover agent.
The Boy Scout motto is "Be Prepared" and that should especially apply when getting ready to do battle in the courtroom, whether in a civil or a criminal case. You should utilize every asset available to your litigation team and making us part of that team gives you an advantage like "going to a knife fight with a gun".
We can help you make sure the prosecution has not forgotten what the Supreme Court stated in United States v. Berger, 295 U.S. 78,88 (1935), "the United States is the representative not of an ordinary party to a controversy, but of a sovereignty whose obligation to govern impartially is as compelling as its obligation to govern at all; and whose interest, therefore, in a criminal prosecution is not that it shall win a case, but that JUSTICE shall be done".
A government agent recently commented that even if they made mistakes in their investigation the jail time would still be the same, so it did not matter. This attitude should strike fear in all citizens and unfortunately has become more prevalant in agencies' desire to win. This is very dangerous and gives the blindfolded "Lady Justice" a new meaning, and another reason for a strong defense team. Unfortunately, accuracy appears to be losing its priority in some prosecution efforts to "make a case" or a statistic. The blindfold needs to be ripped from "Lady Justice" in those cases, so that truth can prevail, and we have the ability to to help you accomplish it. The U.S. Supreme Court said it best in Krulewitch v. United States, 336 U.S. 440 (1949), "Few instruments of injustice can equal that of implied or presumed or constructive crimes. The most odious of all oppressions are those which mask as justice".
Our philosophy in criminal cases is to assist in a strong defense and see that JUSTICE is done, by making sure that the government is fair and accurate in their prosecution and investigation. "Close enough for government work" is not an excuse in a criminal case where so much is at stake and if the government is going to accuse you, lets make sure they have done their job.
